How You Can Affordably Beat a Driving Under the Influence (DUI) Case in Arizona

If you’ve recently been arrested for DUI in Arizona, you’re probably feeling scared and overwhelmed. You’re facing serious penalties, including fines, jail time, and a suspended license which also add up to some major costs to deal with if convicted of even a first offense today.

But don’t give up hope. There are several ways to fight and get a DUI charge dismissed, even if you were under the influence while driving.

As top-rated DUI lawyers in Arizona with over 26 years of expertise specializing in this field of law, we’ve seen firsthand how even seemingly hopeless cases can be won and without draining your finances on heavy legal fees.

10 Best Ways to Fight a Arizona DUI Charge to Get Dismissed

Here are 10 potential strategies for affordably fighting to beat a DUI charge in Arizona by getting a case dismissed quickly, each with additional insights to help you understand your best winning defense options better:

  1. Challenging the Legality of the Traffic Stop: Police need ‘reasonable suspicion’ to justify a traffic stop. If they lacked a valid reason, such as stopping you based on race, ethnicity, or other unjustifiable factors, you may have grounds to exclude evidence against you.
  2. Challenging the Legality of Your Arrest: Just as with traffic stops, arrests require ‘probable cause.’ If the police arrested you without a valid reason to believe you were driving under the influence, this could potentially lead to the exclusion of evidence.
  3. Questioning Field Sobriety Test Results: Field sobriety tests can be unreliable, and various factors may impact their accuracy. If the administering officer made mistakes during the tests, the results can be disputed. For example, did they provide clear instructions, and were you physically able to perform the tests as expected?
  4. Disputing Breathalyzer Test Results: Similarly, breathalyzer test results can be challenged. Your lawyer can investigate the accuracy of the equipment used, its calibration, and the timing of the test in relation to your last drink. If you have any medical conditions, make sure to discuss them, as they could affect your BAC reading.
  5. Utilizing the ‘Rising BAC’ Defense: Your blood alcohol concentration (BAC) does not instantly peak after drinking. If you drove shortly after consuming alcohol, your BAC might have been below the legal limit when you were driving, despite registering above the limit on a breathalyzer. This is known as the ‘rising BAC’ defense.
  6. Providing Alternate Explanations for Your Appearance of Intoxication: Factors like bloodshot eyes and a flushed face can suggest intoxication, but they can also have alternative explanations. Were you suffering from allergies or fatigue?
  7. Providing Alternate Explanations for Your Driving Behavior: Swerving or slowing down unexpectedly may not always be related to impairment. Your lawyer can help explore other possible reasons for your driving behavior.
  8. Exercising Your Right to Remain Silent: After a DUI arrest, it’s advisable to exercise your right to remain silent to avoid self-incrimination. Be aware that anything you say can be used against you.
  9. Asserting Your Right to an Attorney: Hiring an experienced attorney is crucial when facing a DUI charge. They can provide you with the best chance to challenge the case effectively. Consult with a DUI lawyer early to ensure your rights are protected throughout the legal process.
  10. Raising Doubts About the Prosecution’s Case: The prosecution must prove your guilt beyond a reasonable doubt. If you can cast doubt on any aspect of their case, such as questioning the validity of your BAC reading, it may be enough to avoid a conviction. Your attorney can thoroughly investigate the evidence and look for weaknesses in the prosecution’s case.

Furthermore, there are significant physiological differences regarding how women metabolize drinks with alcohol than men.

Due to this fact, many women have certain winning DUI defenses to get charges dropped or have a DUI case thrown out of court when an arrest review can identify these, or other arrest-specific defenses which another lawyer may have overlooked entirely.

2 thoughts on “How You Can Affordably Beat a Driving Under the Influence (DUI) Case in Arizona”

  1. I decided to change lanes to go different direction on freeway. The officer told me I did not change lanes safely. Then asked me to get out of the car, did the eye to pen test, told me to blow in his device. Cuffed me and took me to a bus where he filled out paperwork and told me I blew a .89 or .09 which I didn’t know what that meant which is why I partially am forgetting the number so I asked and he said that means I’m just barely over legal limit.

I do not understand how that is possible because I had 3 light beers over the course of 3 hours and the last one I had was a little before 10pm and I’m taking this test a few minutes before midnight. He read me my Miranda rights after the breathalyzer 8000 machine and asked how much I had which what I just put which was the truth.

I do not understand how I could possibly be over the limit and how fast it happened. I am very responsible (or at least I try to be) if I believe I am never in a condition to drive I do not. I ask friends for rides or DD all the time, I do not understand how I could be under the influence at all?? Am I just screwed and that stupid or what?

I feel like I’m missing something, I am not like this at all and now I’m obviously scared because I swear on my life if I thought I was remotely under the influence or even close to it I would not have driven. What can I do? Any help is greatly appreciated. Thank you
